OSHA emite una norma temporal de emergencia (ETS, por sus siglas en inglés) en circunstancias limitadas. La agencia debe determinar que los trabajadores están expuestos a un peligro grave por nuevos peligros o sustancias o agentes tóxicos determinados como físicamente nocivos y que se necesita una ETS para protegerlos. Una vez publicada en el Registro Federal, la ETS entra en vigor inmediatamente y permanece vigente hasta que sea sustituida por una norma permanente. La ETS también sirve como propuesta de norma permanente y está sujeta al procedimiento habitual de notificación y comentario para la adopción de una norma permanente, con la salvedad de que debe finalizarse en un plazo de seis meses. Los planes estatales deben contar con una ETS que sea al menos tan efectiva como una ETS emitida por OSHA federal 30 días después de su publicación. As we recognize the 20th anniversary of the terrorist attacks in New York, Virginia, and Pennsylvania on September 11, 2001 and remember those whose lives were lost or impacted, we will also never forget those who answered the call in the following days, weeks, and months. This includes the thousands of emergency responders and volunteers who worked tirelessly day and night to remove debris and search through the rubble for potential survivors and recover the remains of those we lost. It also includes many members of the OSHA staff from both Federal and State Plan programs, who worked at the World Trade Center recovery site to ensure that workers had the protections that they needed to perform their work. As a result of these efforts and the unprecedented collaboration between all sectors and levels of government, no workers lost their lives during the recovery efforts that followed this national tragedy. Two decades later, we remain thankful and proud of these heroes and their efforts in the face of chaos and uncertainty. Adblock test (Why?)

Under federal law, your employer must keep your workplace free of known health and safety hazards. You have the right to speak up about hazards or file an OSHA complaint without fear of retaliation. You also have the right to receive workplace safety and health training in a language you understand, receive required safety equipment, request an OSHA inspection and speak to the inspector, and report an injury or illness. Employers are responsible for providing workplaces free of known safety hazards. This includes protecting indoor or outdoor workers from extreme heat. Heat conditions can change rapidly and management’s commitment to adjusting heat stress controls is critical to prevent heat illness. OSHA has updated heat resources to help keep workers safe. Also, some states have adopted standards that cover hazards not addressed by federal OSHA standards. California, Minnesota and Washington have standards for heat exposure. Adblock test (Why?)

Employers must provide training in a language and at a literacy level the worker understands. If workers speak different languages or are at different literacy levels, the employer must ensure all training materials are presented so that each employee can understand. This may require the creation of various training materials in different languages. The implementation of training programs, including how training is conducted and by whom, may vary based on the size and type of workplace or business, and employers have some flexibility to adapt training to their specific workplace. Employers can offer training in a variety of formats, including online, virtual, instructor-led, or application-based methods, but employers must ensure that workers get answers to their questions. There are different ways employers can ensure comprehension of the training materials, including a knowledge check (e.g., written or oral assessment) or discussion after the training. OSHA issues an emergency temporary standard (ETS) under limited circumstances. The agency must determine that workers are exposed to a grave danger from new hazards or toxic substances or agents determined to be physically harmful and that an ETS is needed to protect them. Once published in the Federal Register, an ETS takes effect immediately and remains in effect until replaced by a permanent standard. The ETS also serves as a proposal for a permanent standard and is subject to the usual notice and comment rulemaking procedure for adopting a permanent standard except that it must be finalized within six months. State Plans are required to have an ETS that is at least as effective as an ETS issued by federal OSHA 30 days following publication. OSHA’s newly published ETS to protect healthcare workers from COVID-19 is the first one issued in 38 years. Adblock test (Why?)

The Department of Labor and OSHA, as well as other federal agencies, are working diligently to encourage COVID-19 vaccinations. OSHA does not wish to have any appearance of discouraging workers from receiving COVID-19 vaccination, or disincentivizing employers’ vaccination efforts. As a result, OSHA will not enforce 29 CFR 1904’s recording requirements to require any employers to record worker side effects from COVID-19 vaccination through May 2022. We will reevaluate the agency’s position at that time to determine the best course of action moving forward. Adblock test (Why?)

Employers are responsible for protecting workers from temperature extremes and should establish a heat illness prevention program if workers are exposed to conditions that can cause heat illness. Elements of an effective program include: providing workers with water, rest and shade; gradually increasing workloads and allow more frequent breaks for new workers to build a tolerance for working in the heat (acclimatization); modify work schedules as necessary; plan for emergencies and train workers about the symptoms of heat-related illnesses and their prevention; and monitor workers for signs of illness.
