Canada Publishes Notices to Gather Information for Potential Risk Management of Certain Substances

by Tammy J. MurphyOn April 1, 2017, two separate Notices requiring the submission of information for selected substances were published in the Canada Gazette, Part I. The Notices were issued by the Department of the Environment, under paragraph 71(1)(b) of the Canadian Environmental Protection Act, 1999 (CEPA, 1999).These Section 71 Notices require those persons who meet the stipulations as detailed in Schedule 2 of the respective Notice to submit the requested information on-line, via Environment and Climate Change Canada's Single Window, by the stated deadline:* The "Notice to provide information for the risk management of certain substances – Summer 2017” has a reporting deadline of June 28, 2017, 3:00 pm, E.S.T.* The "Notice to provide information for the risk management of certain substances – Fall 2017” has a reporting deadline of September 27, 2017, 3:00 pm, E.S.T.The information gathered from both Notices is "for the purpose of assessing whether to control, or the manner in which to control" substances listed in Schedule 1 of each Notice. Please see Schedule 1 of each Notice for a full list of substances.Schedule 3 of each Notice defines “manufacture,” "manufactured item," "mixture," and "product" as well as the information reporting requirements. Some of the information required to be submitted includes: CAS number, quantity, applicable substance function or consumer and commercial codes (found in tables that are part of the Schedule), etc.Each separate Notice should be consulted for a complete list of substances, full details on persons required to submit information and comprehensive information requirements.Additional information may be found on Environment and Climate Change Canada’s CEPA Registry website.
