Canada Issues New Regulations in Regards to New Fees and Charges for Pesticides and Pest Control Products

by Tammy J. MurphyIn Canada, pesticide products are regulated by the Pest Control Products Act and Pest Control Products Regulations. This includes substances in pest control products, as well as micro-organisms, chemicals, or polymers used in pest control products.Pest control products are required to be registered and evaluated prior to use and/or manufacture. Part of the registration/evaluation process is the payment of associated fees that vary in cost. There are also annual charges associated with pest control products. Some of these fees and charges are currently described in the Regulations Prescribing the Fees to be Paid for a Pest Control Product Application Examination Service Provided by or on behalf of Her Majesty in Right of Canada, for a Right or Privilege to Manufacture or Sell a Pest Control Product in Canada and for Establishing a Maximum Residue Limit in Relation to a Pest Control Product.In the 22 February 2017 edition of the Canada Gazette, Part II, the Pest Control Product Fees and Charges Regulations (SOR/2017-9) were published.
