Τον στιγματισμό και τη λεκτική κακοποίηση των τρανς ανθρώπων από μέρος των μέσων ενημέρωσης, καταγγέλλει το Σωματείο Υποστήριξης Διεμφυλικών με αφορμή την ειδεχθή παιδοκτονία και την κακομεταχείριση προφυλακισμένων τρανς γυναικών στις φυλακές της Κέρκυρας.

"Το Σύμφωνο Συμβίωσης βασίζεται στις αρχές της ελευθερίας του ατόμου και στο δικαίωμα του αυτοπροσδιορισμού. "Το σχέδιο της νέας κυβέρνησης για την αστυνομία, το Ειδικό Επιχειρησιακό Σχέδιο Αστυνόμευσης για τον Δήμο της Αθήνας, δεν αντιμετωπίζει συγκεκριμένα τις εν λόγω πρακτικές, γεγονός που εγείρει ανησυχίες ότι οι καταχρηστικές ενέργειες ενδέχεται να συνεχιστούν, δήλωσε η Human Rights Watch.
Οι αστυνομικές πρακτικές προσαγωγής και μεταγωγής ατόμων σε κεντρικά αστυνομικά τμήματα και σε άλλες περιοχές της πόλης παρεμπόδισε τη δυνατότητα των προσαχθέντων να έχουν πρόσβαση σε κοινωνικές υπηρεσίες, υπηρεσίες πρόληψης για θέματα δημόσιας υγείας και ιατροφαρμακευτική περίθαλψη. Εικοσιένα άτομα περιέγραψαν καταστάσεις στις οποίες οι αστυνομικοί έλεγχοι είχαν άμεσο ή έμμεσο αρνητικό αντίκτυπο στο δικαίωμά τους στην υγεία, περιλαμβανομένης της παρεμπόδισης της πρόσβασής τους σε ιατρό και σε απαραίτητη φαρμακευτική αγωγή, καθώς και σε υπηρεσίες και ενημέρωση σχετικά με την πρόληψη του HIV, σε μεθαδόνη και άλλα συνταγογραφούμενα φάρμακα."

An official repeal of Health Decree 39A has been published on the Official Journal of the Hellenic Republic as of Friday, April 17. The decree led to the case chronicled in our documentary which involved the mandatory testing and prosecution of a group of HIV-positive women, most of them injecting drug users, in a 2012 police operation in central Athens.

The minister of health P. Kouroumplis has signed a repeal of the decree’s reinstatement by Adonis Georgiadis in July 2013 (a month after it was first repealed by former deputy minister Foteini Skopouli).

Health decree 39A was an attempt by our former governments to distract the Greek public -with the help of the media- from the disastrous effect of their inhumane austerity policies.

The decree has had many victims. Firstly, the women that were targeted 3 years ago, as well as those among them who are still facing trial in the Greek courts. The signing of the decree was also followed by the victimization of thousands of people including women, men, Greek citizens and migrants, victims of trafficking, injecting drug users and members of the LGBT community, who were rounded up and violated through mandatory blood tests during the original police operation by former ministers Loverdos and Chrysochoidis, as well as in later operations such as Xenios Zeus.

The decree launched a mass, organized campaign of misinformation that continues to this day and promotes irresponsible and unacceptable generalizations about the HIV virus and AIDS (the disease that is caused by the virus in the absence of treatment).

Its supporters promoted the view that mandatory exams, criminal prosecution and the scapegoating of vulnerable populations is a valid public health tactic in spite of a lack of evidence to support this claim and the ever-increasing international concern that such tactics of repression have the opposite of the desired effect on public health.

Decree 39A and the women’s arrests also put Greece on the shameful world map of countries that have criminalized HIV, and was widely condemned by UNAIDS among many international organizations and renowned scientists and experts.

The repeal of 39A must be followed by further initiatives to protect human rights and to reverse the stigma it has left on our society and political life. Our institutions must address with resolve any attempts from anyone in a position of power to repeat similar actions inspired by 39A, that could risk the life and well-being of vulnerable people.

We in the production team of the documentary Ruins: Chronicle of an HIV Witch-Hunt, wish to thank the members of all those organizations and initiatives, who fought for the repeal of the decree and who have made efforts to keep the public informed about the relevant issues for the past three years, as well as for their ongoing support to the victims.

Εκδόθηκε το ΦΕΚ (αρθιμός φύλλου 627) με την κατάργηση της Υγειονομικής Διάταξης 39Α, γνωστής και ως «διάταξης Λοβέρδου.»

Ο υπουργός υγείας Π. Κουρουμπλής καταργεί πλέον και επίσημα την επαναφορά της διάταξης από τον Άδωνι Γεωργιάδη η οποία είχε γίνει τον Ιούλιο του 2013, ένα μήνα μετά την απόσυρση της αρχικής διάταξης Λοβέρδου από την πρώην υφυπουργό Φωτεινή Σκοπούλη.

Η διάταξη 39Α ήταν μια απόπειρα να αποπροσανατολίσουν την κοινή γνώμη οι κυβερνώντες, –με τη βοήθεια των ΜΜΕ– από τις ευθύνες τους για τις επιπτώσεις στη δημόσια υγεία της λιτότητας και των απάνθρωπων πολιτικών τους.

Η διάταξη 39Α είχε και έχει θύματα. Τις γυναίκες που στοχοποιήθηκαν πριν ακριβώς 3 χρόνια και εκείνες που ακόμα αντιμετωπίζουν σαθρές κατηγορίες. Επίσης, τους χιλιάδες ανθρώπους, γυναίκες, άντρες, Έλληνες πολίτες και μετανάστες, τα θύματα τράφικινγκ, τους χρήστες ενδοφλέβιων ουσιών και τα μέλη της ΛΟΑΤ κοινότητας, που δέχτηκαν τον εξευτελισμό και τη βία των προσαγωγών και εξαναγκαστικών εξετάσεων αίματος τόσο κατά την επιχείρηση Λοβέρδου – Χρυσοχοΐδη το 2012, όσο και αργότερα, στον Ξένιο Δία και σε άλλες μεμονωμένες αστυνομικές επιχειρήσεις.

Η διάταξη υπήρξε η αφετηρία μιας μαζικής και οργανωμένης παραπληροφόρησης που συνεχίζεται μέχρι σήμερα και περιλαμβάνει ανεύθυνες και απαράδεκτες γενικεύσεις για τον ιό HIV και για το AIDS (την νόσο που μπορεί να προκαλέσει ο ιός αν ο φορέας δεν χορηγηθεί με την απαραίτητη θεραπεία).

Η διάταξη ενίσχυσε την επικίνδυνη λογική ότι οι εξαναγκαστικές εξετάσεις, οι διώξεις και η στοχοποίηση ευάλωτων ομάδων είναι απαραίτητη τακτική για την προστασία της δημόσιας υγείας παρά την έλλειψη στοιχείων για τον ισχυρισμό αυτό και τις όλο και αυξανόμενες διεθνής αντιδράσεις για το ότι η καταστολή αναχαιτίζει την υποστηρικτική δράση και έχει το αντίθετο αποτέλεσμα.

Η διάταξη έβαλε τη χώρα μας στον ντροπιαστικό παγκόσμιο χάρτη των χωρών που ποινικοποιούν την οροθετικότητα και παραβιάζουν τα δικαιώματα των ανθρώπων που ζουν με τον ιό HIV, με αποτέλεσμα να δεχτεί τα πυρά σημαντικών διεθνών φορέων –όπως το τμήμα των Ηνωμένων Εθνών UNAIDS– οργανώσεων ανθρωπίνων δικαιωμάτων και επιστημόνων διεθνούς κύρους.

Η κατάργηση της 39Α θα πρέπει να οδηγήσει και σε περαιτέρω πρωτοβουλίες για την προστασία των ανθρωπίνων δικαιωμάτων και για να ανατραπεί το στίγμα που άφησε στην πολιτική σκηνή και την κοινωνία. Οι θεσμικά υπεύθυνοι θα πρέπει να αντιμετωπίσουν με θάρρος και αυστηρότητα όσους από θέση εξουσίας και θεσμικού κύρους πιθανόν επαναλάβουν παρόμοιες ενέργειες υπό το πνεύμα της 39Α που μπορεί να θέσουν σε κίνδυνο τη ζωή και την υγεία ευάλωτων ανθρώπων.
