by Thuy DangOn July 1st, 2016, Vietnam published a new decree, Decree No. 91/2016/ND-CP, regulating insecticidal and germicidal chemicals and preparations for household and medical use. This regulation excludes chemicals only used in the sterilization of medical equipment.This Decree defines the conditions for establishments producing insecticides and disinfectants and defines mandatory content for the labels of registered preparations as well as what ingredients cannot be used.Decree 91/2016/ND-CP also regulates the application and registration procedures for circulation and has provisions on trade name, labeling, packaging, preservation and destruction of chemicals and preparations.Additionally, this decree identifies conditions for import and export, conditions for sale and transportation of chemicals and preparations, and provides guidance for publication and online registration.Decree 91/2016/ND-CP took effect on July 1, 2016, but there are transitional provisions as follows:1. Manufacturers of chemicals and/or preparations which have operated before the effective date of this Decree may continue their operation provided the declaration of eligibility for production is made before July 1, 2017.2. Testing or experiment establishments for chemicals and/or preparations which have operated before the effective date of this Decree may continue their operation provided the declaration of eligibility to conduct testing or experiment activities is made before July 1, 2017.3. Applications for the registration of sale of preparations or issuance of import licenses which have been received before the effective date of this Decree shall be handled in compliance with the laws applicable at time of receipt.4. Chemicals or preparations which have been issued with registration numbers before the effective date of this Decree shall be sold until the issued registration numbers expire.5. Chemicals or preparations which have been issued with registration numbers before the effective date of this Decree shall be sold, provided the labeling of chemicals or preparations must be made as referred to in this Decree before July 1, 2018.6.
